What can you claim for?
When you are Claiming compensation you should take the neccessary steps to obtain as much evidence and proof as you can. You should also report or at least make a note of the accident, where possible, and describe your injuries in as much detail. There are two categories of damages for which you can claim: 'Special' and 'General' damages. In Scotland, special damages are called damages for patrimonial loss and the equivalent of general damages is solatium; both are often loosely referred to as damages.
Special Damages
Special damages are payable to compensate you for a direct financial loss that you have sustained, for which a precise figure is available. These include items that are usually easy to calculate accurately and may include;

This would include net loss of earning, cost of repairs to car, value of damaged clothing, taxi fares, any other expenses that can be specifically itemised. Nobody is going to compensate you unless you can show that you have actually incurred those expenses, which is why we mentioned earlier to make notea on your accident. You should keep a note of the amounts spent and keep reciepts. If you have reciepts to produce, it is likely that those sums at least will not be in dispute.
All reasonable costs of treatment necessary as a result of your accident will normally be allowed, whether private or under the NHS. This includes the cost of drugs or appliances and the cost of getting to and from treatment, as well as any medical fees.
General Damages
Part of your claim will be for general damages, to compensate you in financial terms for the pain and suffering which have been caused.
Unlike special damages where you can claim a precise amount for each item, for general damages you do not specify exact figures but list the factors for which you seek compensation: the pain or suffering, the physical effect, including any cosmetic effect, that you have had to endure and may still have to endure, and the foreseeable risk of later ill effects.
The claim includes the loss of amenity - that is, that since the accident you have not been able, and may not ever again be able, to perform all the tasks and activities that you normally did. The loss of amenity claimed can include restrictions on persuing a hobby.

A claim for general damages will have to be supported by medical evidence showing that you have sustained those injuries and in what way and for how long the injuries are likely to affect you.
